Special Note for Parents and Legal Guardians

ALTality adheres to U.S. Children’s Online Privacy Protection Act of 1998 and its rules (“COPPA”) with respect to our Website and App. Please help us protect the privacy of your children, especially those under 13, by instructing them never to provide personal information (for example, their full name, e-mail address, home address, or telephone number) without your permission.

Information Regarding Children Under 13

COPPA requires us to inform parents and legal guardians (“Parents”) about our practices for collecting, using and disclosing personal information of children under the age of 13 (“Children”). It also requires us to obtain verifiable consent from each Child’s Parent for certain collection, use and disclosure of the Child’s personal information.

This section notifies Parents of:

·       the types of information we might collect from Children;

·       how we might collect that information;

·       how we use the information we collect;

·       our practices for disclosing that information;

·       how a Parent may access and change the Parent’s Child’s personal information or revoke consent; and

This section applies only to Children and supplements the other provisions of this Privacy Policy, which applies to users over the age of 13.

a.     What Information Does ALTality Collect from Children and How Does ALTality Obtain Parental Consent?

Children can access many parts of the Website and App. Many of the features of the Website and App can be used without providing us with personal information. However, some content and features are available only to registered users or require us to collect certain information from our users (including Children), including personal or personally identifiable information under applicable law, when they visit or use the Website or App.

We only collect as much information about a Child as is reasonably necessary to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.

When a Parent is asked to create an account for the Parent’s Child, we will ask the Parent to provide the Child’s name and birthdate, create a username for the Child’s account (“Child Account”) and provide verifiable consent to ALTality’s collection of personal information regarding the Child.

Do We Collect Any Information Automatically?

Our Website and App use technology to automatically collect information from our users, including Children, when they access and navigate through our Website, App and certain user features.

Our Website and App might be used to automatically collect:

·       Usage Details. When a Child accesses and uses the App or Website, we might automatically collect certain details of the Child’s access to and use of the App and Website, including traffic data and logs.

·       Device Information. We might collect information about the mobile device used to access the App and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information and the device’s telephone number.

We might also collect information using one or more persistent identifiers that can be used to recognize a user over time and across different websites and online services.

If you do not want us to collect this information, delete the App from your device or do not download it and do not continue to use our Website.

b.     How is a Child’s Information Used?

We use the personal information we collect from a Child to register him or her with the App and track his or her usage of features in AR Experiences.

We use the information we collect automatically through technology, including non-personal information, to improve our Website and App and to deliver a better and more personalized experience. This information enables us to estimate our audience size and usage patterns, store information about the Child’s preferences and customize the content according to individual interests.

c.     How and When Do We Disclose a Child’s Information?

We do not sell any Child personal information. We do not share any Child personal information, other than as described in this section below.  

We may disclose Child personal information:

·       to third parties (whether that third party automatically collects information or otherwise) as part of the central features of our App or Website;

·       if we are required to do so by law or legal process, such as to comply with any court order or subpoena, to respond to a law enforcement agency or for an investigation related to public safety; or

·       if we believe disclosure is necessary or appropriate to protect the rights, property or safety of ALTality, our customers or others, including to protect the safety of a Child, protect the safety and security of the App or Website, or enable us to take precautions against liability. 

In addition, we may disclose aggregated, anonymized information about many of our users (including Children) and any other information that does not identify any individual or device.  

d.     How Can a Parent Access and Correct His or Her Child’s Personal Information?

At any time, a Parent may review his or her Child’s personal information maintained by us, require us to correct or delete the personal information or refuse to permit us from further collecting or using the Child’s information. A Parent can review, change or delete his or her Child’s information by sending us an e-mail at support@spellboundAR.com. Please note that we cannot delete all of the personal information from the Child Account without deleting the entire Child Account.

Information Regarding Users Other Than Children

We collect information from you both directly (when you provide it to us) and automatically (when you use the App and Website).

a.     Information You Provide to Us

To make a purchase on our Website or App, you must be 18 or older with a valid credit card. When you place an order, we collect information associated with the transaction, which might include your name, mailing address, billing address, phone number, e-mail, products ordered, shipping address and credit card information, as well as ship-to information if products are intended for someone other than the purchasing customer. You might have an option to register certain information for future orders, while completing orders online. For users who choose to register, we might capture and save the following information: login name, password, name, mailing address, phone number and e-mail. We will not save a user’s credit card information.

When you download, register with or use our App, we might ask you to provide:

·       information by which you might be personally identified, such as your name, postal address, e-mail address, telephone number or any other information the App collects that is defined as personal or personally identifiable information under applicable law; or

·       information that is about you that does not identify you, such as IP address or unique device ID.

In addition, this information may be requested and collected:

·       when you fill out forms in or through the App or on or through the Website, including responding to a survey that we might ask you to complete for informational purposes and signing up to receive e-mails from us;

·       when you report a problem with the App or Website or otherwise contact us; and

·       during any search queries or when you save preferences in the App or on the Website. 

b.     Automatic Information Collection and Tracking

When you download, access and use the App or Website, it might use technology to automatically collect:

·       Usage Details. When you access and use the App or Website, we might automatically collect certain details of your access to and use of the App and Website, including traffic data and logs.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

·       provide you with the App, AR Experiences and other content, products or services that you request from us;

·       fulfill any other purpose for which you provide it;

·       carry out obligations and enforce our rights arising from any contracts entered into between you and us, including the ALTality End User License Agreement and Terms of Use, and to notify you of any changes to any of those contracts or this Privacy Policy;

·       for billing and fulfilling your orders; and

·       notify you when App updates are available and of changes to products or services we offer or provide through the App or Website. 

The usage information we collect helps to improve our App and Website and to deliver a better and more personalized experience. This information enables us to estimate our audience size and usage patterns, store information about your preferences, customize the content according to your interests, speed up your searches, and recognize you when you use the App. 

We might also use your information that you provide to us to contact you about our products and services that might be of interest to you. If you do not want us to use your information in this way, please send an e-mail to support@spellboundAR.com or unsubscribe from our e-mail offerings. 

Disclosure of Your Information

We do not sell your personal information. We do not share your personal information other than as described in this section below. 

We may disclose your personal information that you provide to us:

·       to third parties (whether that third party automatically collects information or otherwise) as part of the central features of our App or Website;

·       to fulfill the purpose for which you provide it (for example, if you give us an e-mail address to use an “e-mail a friend” feature on our Website or App, we will transmit the contents of that e-mail and your e-mail address to the recipients);

·       for any purpose disclosed by us when you provide the information;

·       with your consent;

·       if we are required to do so by law or legal process, such as to comply with any court order or subpoena, to respond to a law enforcement agency or for an investigation related to public safety;

·       to enforce our rights arising from any contracts entered into between you and us, including the ALTality End User License Agreement and Terms of Use;

·       for billing and fulfilling your orders;

·       if we believe disclosure is necessary or appropriate to protect the rights, property or safety of ALTality, our customers or others; or

·       to a buyer or other successor in the event of a merger, divestiture, reorganization, dissolution or other transfer of some or all of ALTality’s assets or equity, whether as a going concern or part of a bankruptcy, liquidation or similar proceeding, in connection with which personal information held by ALTality about our Website or App users is among the assets transferred.

We may disclose aggregated, anonymized information about many of our users and any other information that does not identify any individual or device.

Third-Party Information Collection

When placing an order through our Website, the transaction is handled by a third-party vendor on or through our Website. In addition, you might purchase and download the App through a third-party mobile application online store. When you purchase or download the App from a third party, you might be required to register with the mobile application store and log in before you can download the App. When downloading the App, the mobile application store will typically collect certain device and application-related information. When you receive or fill out any survey or questionnaire from or through our Website or App, a third party typically will provide, host and report to us the information submitted by you and other users through the surveys and questionnaires.

When you use the Website or App, certain third parties might use automatic information collection technologies to collect information about you or your device. These third parties might include your mobile device manufacturer and your mobile service provider. We do not control these third parties’ tracking technologies or how they might be used.

Accessing and Correcting Your Personal Information

You may send us an e-mail at support@spellboundAR.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete all of your personal information without also deleting your user account. We may, in our discretion, not accommodate a request to change information if we believe the change would violate any law or legal requirements or cause the information to be incorrect.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure.

Our ability to protect the safety and security of your information depends, in part, on you. Where you have been given or chosen a password for access to certain parts of our App and Website, you are responsible for keeping this password confidential. Please do not share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App and Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We might update our Privacy Policy from time to time, including making changes to how we treat our users’ personal information. The new Privacy Policy will be posted on this page, and we will notify you by an alert (whether in the App, on the Website or by e-mail) after we make the change. 

The date the Privacy Policy was last revised is identified at the top of this Privacy Policy. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you and for periodically visiting the Privacy Policy to check for changes.

International Users

The App and Website are hosted in the United States and are intended for visitors located within the United States. We may transfer your data from the United States to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Website and App. By providing any information, including personal information, on or through the Website or in or through the App, you consent to such transfer, storage and processing.
